According to the report of The European Committee of Social Rights Albania doesn’t meet the provisions of the European Social Charter.
In spite of the fact that Albania also ratified the Charter there are some articles of it (16, 17, 27 and 31) which are not accepted. These would guarantee the protection of families’ and children’s rights. Due to the report 17 non-conformities have been detected in Albania, most of them would help the fight against children labour and sexual exploitation.
The government in Albania doesn’t provide appropriate information regarding data of children labour or measures against it and there are not any sufficient statistics about exploited children. The definition of “light work” in Albanian law cannot provide the sufficient protection of children under the age of 15 which should be guaranteed acc. to the Charter. Because of these shortages around 15.000 children should be out of school and there are 50.000 children who must work to ensure the survival of their families, though the wages of young people are manifestly unfair.
Another significant problem of the situation of Albanian working women, their maternity leave benefits are not guaranteed, they can be dismissed during maternity leave but if they can overcome the first two obstacles, the reinstatement is also not ensured.
Furthermore, there are several failures regarding the rights of migrants also.
