In Hungary, the law prohibits children being taken away from the family because of their poverty, but one-third of the children in care are separated from their families due to this reason. In Nógrád County, this percentage is 38 percent and the Ombudsman has indicated this to the Ministry of Human Resources (Emmi) in vain, the situation has not changed since 2017. The European Roma Rights Center sued the Ministry for the situation in Nógrád County and partially won.
In its judgment at first instance, the Metropolitan Court ruled that the Ministry had failed to provide methodological assistance to child protection agencies, thereby maintaining the unlawful practice of child protection bodies to take children away solely for financial reasons.
The court ordered the Ministry to issue, within six months, a methodological guide "on uniform principles for the identification, detection and elimination of material hazards for children on material grounds."
